Well going to jail for this is absolute madness but Microsoft is in it's right to prosecute him, the EULA clearly states it. It's illegal to sell a already used/old computer with a Windows license because a windows license is only legally valid to it's first user. Even tho the guy is a total fag he doesn't deserve to go to jail for this, maybe a small fine or a mandatory uninstalling windows on the PCs customers but not jail. Install Gentoo.

The last time I read a Windows EULA, it said that the software was licensed for the computer, not user. Also, just because software is licensed for that computer doesn't mean a user is required to have it installed.
How are these CD-ROM's not legal backup copies? It would be interesting to see what his lawyer(s) and the prosecution said in argument. Also, how was this a criminal proceeding? Microsoft can't sue for criminal punishment.

You can't make mass copies of Windows binaries, distribute them and say: "Those thousands of copies were all necessary for my PC in case it breaks and I totally haven't sold them" tl;dr you can't distribute your fucking thousands of backup copies of copyrighted content. a backup copy isn't something you make just to give it to all your friends instead
