Despite being a vigilante, Batman very much believes in the law and allowing it to punish criminals once they're arrested. It's why he doesn't kill criminals either. If they can be brought to justice then he'll make sure it happens. If there was a law using the Phantom Zone as a punishment then Batman would oppose it but he wouldn't go about breaking criminals out of it.
Joker would just asspull his way out and become more dangerous than ever.

They tried it once, the Joker put wacky-tobaccy in Superman's apple pie and he ended up sending Batman in there instead. Rumour has it his screams were heard all around the world

There's no logical explanation why they don't just huck him in there or wait until some Gotham PD gets sick of this and fucking drills the Joker with a while gun clip after Batman turns him over, it's solely for meta reasons involving keeping a 'good' villain alive and exploiting both Batman and Superman's mercies to a somewhat implausible degree.

I can't find the page but Superman talks about sending a human to the Zone and Bats counters by saying that it's a punishment for Kryptonians and should never by used for humans.

Gotham's system is too corrupt for criminals to be brought to justice, they always find a way to avoid trials either by escaping from Arkham or by bribing people.

Because the thing with joker is no matter what you do with him he will always find a way to make it so you regret doing it to him. Or that bigger problems end up resulting from it.
If you send joker into a space prison or the Phantom zone or somewhere far away from earth? He’s just going to come back with the anti-life equation and an army of joker venom infested aliens.
If you want a superhero story that actually tells a compelling story? Either read standalone mini series or just avoid Marvel or DC all together because you’ll never see joker get what he deserves in actual DC books because he’s too profitable for WB to kill off.
