It's pretty stupid. The only similarities that they share is that they've both gone against the law and SOCIETY's norms, but the same is true of most, if not all, of Batman's rogue gallery. The only reason that they push "WHOA BATMAN AND JOKER ARE LIKE THE SAME BRO" is because Joker is the most popular DC villain.

Batman is meta-level comedy, there is no other explanation.

I mean, people keep dodging the fact the GCPD obviously can't keep looking the other way on Batman doin' his thing if he starts killing people he thinks deserves it, making Batman's life a lot harder than it needs to be.

A better question might be how the state hasn't killed the Joker, or how the most corrupt police department around hasn't pumped him full of lead "resisting arrest" or "trying to escape" or how he suddenly hung himself in his cell while the cameras were off for completely legitimate reaons.

There are no Watsonian reasons the Joker continues to survive and thrive. His ex, who has no compunctions against killing people, hates him, and yet he lives. Jason Todd, who kills people all the time, hates him, and yet he lives. There is no reason for any of it beyond the writers won't let him die.

The Joker and Batman are only the same in the sense that they are two elements that Gotham can't control. Ideologically, they're fundamentally opposed even if they need each other in some perverse sense.

I mean, the explanation is Batman is the bizarre result of what happens when you take a character designed for edgy pulp loving mass audience, then try to cram it into a family friendly container that panders almost exclusively to small children, only to—decades later—be reclaimed by creators who were kids when it was edgy originally, who then bring back that edginess and magnify it tenfold to try and justify the fact that they've spent most of their adult life as a fan of a character who is essentially a bizarre hybrid of The Shadow and Superman

Basically, the Joker issue is the same as the Superman issue: the people who handle these characters are fucking stupid and are only making things worse as time goes by

I believe the coolest thing about the Joker is thst he is not "insane", like a flaw that can be used against him (like The Riddler megalomania ou Two Face obsession with the coin). The Joker mocks and play nasty pranks for his own amusement. His mockery and elaborate crimes are clearly not designed for profit, nor "prove a point", nor anything beyond the fun of it. He is dangerous because his just a way overcompetent guy who has nothing better to do.

Batman, as his opposite, is way overcompetent as peak human as possible, but is concerned about being a symbol, fighting bad guys the police can't handle and etc. Batman uses his skills for the benefit of others.

The Joker uses his skills for his own amusement.

Batman does not kill because he has no right to kill.

At least in his own opinion. He has a thousand ways to disable any human opponent, especially the Joker, without doing permanent harm.

Then he leaves it to the justice system to determine what happens next. He protects. He is a knight. Not a judge or avenger.

He is not the Punisher, who is an executioner who works from the - equally valid - principle that if you are a murderer or rapist, you have condemned yourself and a grand jury is just an unnecessary formality.

Batman's goal is not to punish, but to protect.

He cannot protect the Joker. There is nothing left to protect. That was basically what 'The Killing Joke' was about: that battle for the soul you suggest, reaching its logical conclusion. The Joker states that it is too late. He thanks his counterpart for the offered hand, but must reject it.

Then there is his way...

It would be so easy for him to pack a handgun. The cops never captured him before. And every 'supervillain' he meets gets a nine-millimeter pardon. Neat! The phrase, I think, is 'reign of terror'.

But that wouldn't make for a very compelling comic.
