They never get any use so you'd be blowing billions on a vacant prison. Closest thing would probably be The Negative Zone from Civil War but even that's a dumb idea given the area. Furthermore, you don't just dumb a superhero in a supervillain prison like The Big House or The Raft.
If you cannot accept this, cape books might not be for you in general. This is a fairly small concession that sounds reasonable in a world filled with superheroes.

We don't think about things like due process in comic books because authors are typically wise enough to steer clear of the nitty gritty of how the criminal justice works in 616. Daredevil has to unmask himself before a district attorney (that he used to work for) who makes his personal disdain for Daredevil clear but allows him to keep the mask during the entire process. They also reference a legal precedent set by more trusted superheroes testifying as their alter ego personas in court before.

the turning point that let him keep his identity secret was addressed in the comic. He unmasked in front of the district attorney and the guy had to cave because if he revealed Matt's identity years of cases would either get overturned or have to be retrialed because one of the attorney's kicked the shit out of the defendant.

But I will give you that something like this did happen with the bookstrore girl that he was banging. At one point, he was just trying to keep her safe from the likes of Owl and help her move out of the city. But she threw a tantrum about how he ackshually doesn't care for her and just wants to make himself feel good and thus makes all the decisions for her, just like her cuck husband.
I'm really not sure how the reader was supposed to react to that, because we obviously do know that Matt cares about others, that's stated in the run itself repeatedly. So I guess we're supposed to sympathize with the girl because her husband treated her poorly and now she feels like everything is a personal attack. So it seems like the story wanted us to side with her just out of pity, even if she was blatantly wrong.
Good luck since most fanfic writers are into 21st century franchises rather than comics.
