If they were arrested they could easily explain their presence and the patient could grant access which would make them non-trespassers so there would be no prosecution.
Even if they didn't receive permission they could argue extenuating circumstances in the interest of the patient's health necessitated their trespassing.

They must have a really good lawyer if they managed to avoid prosecution for all the dozens of times they broke in. Really good.
They outright state in the show that he has tons of malpractice cases against him but he keeps getting away with it because he's viewed as indispensable.
