Tailedbeastsfags almost never die before going into beast mode due to survival instinct kicking in. Sasuke wouldn't have gone for the kill unless he had to, but even if he didn't he still could use chidori a few more times. Garaa's only option was to go into his beast mode which he can't control. That would mean disqualification.
