Writing quality or themes has nothing to do with demographics, if something is published in a seinen magazine its seinen, if something is published in a shounen magazine its shounen that's it.

this is correct. though it's better that the lines between shonen and seinen are blurred rather than distinctive. works that take themselves too seriously and works that don't take themselves seriously enough usually fall on their face. i'd rather not give manga demographic labels at all.
