Here's my theory.
The Scarlet Eyes are a Nen ability created by a Kurta ancestor or progenitor that is powered by Nen after death that is only passed on to descendants genetically. This is why we got introduced to the Kakin seed urn ritual which is the first king's Nen ability. The Scarlet Eyes therefore have their creator's aura, which is the aura boost Kurapika gains from activating them. This is also why Kurapika "becomes" a Specialist. When he has the scarlet eyes activated the Water Divination test is reading the aura of the Scarlet Eyes, in other words their creator's aura.

Sure but it applies to the individual. Nen abilities can't be passed down because a nen category can't be passed down. And implementation of conditions have to do with the individual's will power & emotions. Again, you can't pass that down.
