Can't rape the willing. But raping your enemies (even if they tried to kill you) would still be evil (same as torturing them). In some cases maybe a necessary evil if you tried to get information that could save multiple innocents, but still evil.

My question is based on "raping is evil", which apparently has no conditions, but death does have conditions.

If your species' survival depends solely on rape then it's an evil species so moral questions lose any meaning.
