In the botanical domain, tomatoes are fruits, in that they're a seed-bearing plant part. There's no botanical definition for the category "vegetable", though.

In the culinary domain, tomatoes are vegetables, in that they're plants that are predominately used for their savory flavor rather than for being sweet or sour (which is what fruit are).

Both domains have the category "fruit", but botanically it means one thing and culinarily it means something different. The two categories mostly overlap, so people sometimes treat them as interchangeable, but they don't overlap entirely, and tomatoes are one of the things that are in the group in one domain but not in the other.
