My logic is my dad bought and moved his family into this property under the assumption that nights would be reasonably quiet. In a just society, when the government seizes property, it generously compensates the owners. Generous compensation is an offer so high that a reasonable person would not refuse. The government gives them far more for their house than it is worth.
By doing nighttime construction, the city has temporarily seized the quietness of our house at night. Nighttime quietness is an intangible, yet vital piece of the property.
Therefore, based on the precedent that governments generously compensate property owners for seizures of property and applying the same principle to my case, I think I have a shot at winning.
