depends. Their database was hacked and had their official mail compromised. Anyone who ever bought a ledger got a mail about "official software update" which was a key logger and users got scammed for few or tens of mil. There also was a thread about guy who received a compromised ledger on the way of delivery.
You should be good if you buy it, check the package if it was never opened the way of delivery, send coins to your ledger and never fuck with it until you decide to send it out.

My biggest fear is that resellers have the seed phrase of each device they sell and can clone your wallet to anew ledger if they want. Not sure if this makes sense?

But you can also restore it from a seed.
So you are free to generate a seed using your preferred trusted open source full entropy method and just use this seed on the ledger.
With that knowledge then it should be safe to even buy a used one, as long as it's the original?

But then again, how would you know if all you can do it go on random threads and call people retarded / stupid and convince us how genius you are without knowing what the subject is.
If you are certain it is the original and has not been tampered with, sure.
However, how could you confirm that. Would be trivial to replace the chip with your own that looks like the original but generates not-so-random seeds. I'd strongly suggest buying new and only from the manufacturer. It's a low cost device, not worth the uncertainity.
