That's not quite true, it's just a general rule of thumb and largely centers around the idea that 'dead men tell no tales'. Typically lethal force and threats of lethal force are covered in the same line of the self-defense law, and several red states have specifically passed laws to fix this issue.

The act of firing, or not, doesn't play into it at all. The only thing that matters is if the brandishing of the weapon was legally justified.
