Literally 40% of deaths are from forced nursing home housing of infected patients. Death rate is still less than 2x regular flu even including these. Entirely false. ADA only requires that they "reasonably accommodate" you. They don't have to let you in. And in many cases there's no way to reasonably accommodate that situation. If they have curbside delivery, you have to use it. If they don't, you're fucked. A person who tries this stunt has a zero percent chance of winning a lawsuit.
It might work against a dumbass, and there are plenty of those out there, but if it doesn't and you sue you will get BTFO in court. If you don't actually have asthma but sue and say you do, you may spend six months in jail for criminal contempt and you almost certainly will get a big ass judgment against you for filing a frivolous lawsuit.

If you file an ADA lawsuit, you do in fact have to say in your complaint that you are a qualified individual with a disability under 42 truth. Section 12131(2) and you have to say what it is. The other side gets to do discovery on your medical records and can send you to a doctor to see if you are telling the truth. When they find out you are lying, they will move for summary judgment and seek sanctions against you for frivolous filings which can include you having to pay $100,000 or so in lawyer fees (or more) and might also include you being locked in jail for up to six months for criminal contempt (or possibly more but not likely).

I'm not making an argument. I'm explaining to you what businesses do when someone files a frivolous ADA lawsuit against them. They will move for sanctions and possibly seek to have you charged with and jailed for criminal contempt. You will end up with a judgment against you in the amount of their attorneys fees in most cases, which would probably run about $100,000 in this type of situation, and maybe a lot more in some faggot big city like LA or NY.
