Can a landlord charge for a gas safety check if it is mentioned in a tenancy agreement clause? It does not appear on a list of permitted fees that a landlord can charge under the tenant fees act 2019.

It's a landlords repsonsibility to have a gas safety check done but I never heard of one charging the tenant for it. I don't know if it is legal but that is some serious bullshit.

Everything I have read so far is quite vague. It talks about providing gas certificates, ARRANGING gas safety checks but nowhere is it mentioned about who has to pay for it.
It doesn't appear on the list of permitted fees a landlord can charge nor does it explicity appear on the list of prohibited charges.

If it specifies that the tenant is responsible for that cost in the tenancy agreement, and you signed it, then the landlord can send you the charge for that. Just because the landlord has to have it done, doesn't mean he can't charge it to you.

Since all of the gas appliances are his and a landlord is responsible for ensuring they are safe to use and has to provice a valid certificate at the start of the tenancy it seems illogical to be able to transfer that fee to the tenant.

The act was there to stop fees being charged to tenants before moving in, they were fees estate agents or private landlords were charging to tenants for no reason other than to profiteer. It doesn't cover fees for safety inspections or certificates, even if they are the responsibility of the landlord, and especially when it's stipulated in the tenancy agreement. Why didn't you refuse the agreement, or ask for that stipulation to be removed?

Because I'm not a lawyer, the tenant fees act wasn't a thing back then and because he's a petty cunt who won't repair anything. I was only made aware of how strange this is until it came up in conversation and I started reading about it and tried getting some advice.

Yes, repairs, maintenance, certifications etc are landlords responsibility, but it does not specify that costs for those can not be passed on to the tenant, and it specifically says that's what the landlord proposes to do in the tenancy agreement

On top of that he arranged it 6 weeks earlier to have boiler fixed at the same time, called a different engineer costs £75 instead of the usual £50 and he charged me by sending an e-mail saying
"I hope the boiler is working again. Please send your part of the Gas certificate, I THINK £72 as soon as you can."

I'm waiting for an actual invoice from the gas engineer himself. The reason he did the gas safety check early and at the same time as the boiler repair is to safe a fucking callout charge, I guarantee it.
When the front door handle became lose and wouldn't open properly anymore he turned up in his 30 year old horse box monster, said it was probably the key, got a key cut at Timpsons, realised it didn't work, went back and got a refund for £5. Probably cost him £10 in diesel to get his piece of shit horse box there in the first place.
