Jocelyn Benson then said later it's "not binding", having lied to the R members.
SOS Benson is also saying it's "too late" to decertify the election and she will go ahead and formally certify.
Michigan State Legislature Republicans introduced articles of Impeachment after SOS Benson refused to decertify against the Democratic Governor Gretchen Whitmer so she can't send electors to the EC.

It's too late. Every county has certified its vote, now SOS Benson certifies the entire state, then Governer Gretchen sends the 16 D electors to the EC.

No, the 12th amendment states that if neither candidate has enough EC votes or there is a tie, then another election occurs in the house with each state reduced to 1 elector. Since there are more R states, Trump wins by default.

Yes, and they can also send R elector which is looking very likely after this bullshit. Gretchen can still send her D electors but this is a scenario known as "dueling electors". It's only happened once before in the 1870s with Tildon/Hayes when 3 states sent dueling electors.
