fan games are fine until they encroach too much. if they start resembling something people would otherwise pay for if the dev made it they need to be shut down to uphold the notion of "must pay money to get new quality installment."
there are a shitton of fangames or romhacks better than the originating game that stay up cuz they're unknown or don't encroach too much. chrono resurrection clearly occupies the encroaching category. if properly realized it would he the definitive version of the game, and for free!

Emulators themselves don't make use of any copyrighted content. If you want to play a game, you need a rom to run in the emulator.
Fan games make use of characters, storylines, and sometimes even assets like sprites, textures, and music from the original games.

Chrono Trigger Resurrection was not going to be a complete remake of Chrono Trigger. It was going to only be a select few noteworthy scenes in the game. An emulator is a piece of software made by someone to emulate another piece of software and/or hardware.
Fan made games are using the actual software or the characters etc. - shit owned by the ones who made the game unlike the brand new emulation software.
Emulators would be illegal too if they used parts of the original code - ISOs, for example - from the original system.
