But Retro is both busy and a total mess right now, and Rare is a shadow of their former selves and are under Microsoft regardless. So what could they even do with Donkey Kong?

They've never really known what to do with Donkey Kong after Rare divorced them and Retro has been exiled to the Phazon mines for the next 10 years so it's just kind of sat there while they figure something out. We'll presumably see what they arrived at within a year or two.
Companies have to file trademarks for things they aren't using but plan to use for merchandising etc or risk losing them.
And yes I know they specifically said Country. But I bet this is just Nintendo nostalgia milking so every game or product regardless is going to be called Donkey Kong Country now.
