Games traditionally have legal leeway to be mechanically and visually similar as long as they're not actually trying to confuse people into thinking it's the same product, Nintendo themselves started out making pong clones. I member a time where it was the norm that devs aped superior games simply because they were so much better then anything else at the time. Nintendo was a prime target for it in the 90s with tons of other devs making the same game as them with a different skin.
