Probably depends on the developer/publisher. Squeenix composers are notoriously stingy with music releases. So no Final Fantasy music. Meanwhile SNK were probably incredibly enthusiastic to be in Smash and just let Sakurai take the whole pickings.
Who made the Minecraft music anyways? I doubt Mojang or MS would not let them use music.

But SE is stingy as fuck, most likely because SE doesnt own (or fully own) the music in their own games, the composers for said games do.
