for some things, if they have a license that still goes on in this day and age or themselves released it to the current marked I'd say that's actually piracy (or at least in legal terms, do what you want I don't care),
but for some I'd bet your ass most companies (be it publishers or devs who held the license or rights) went under in the late 2000s (if they have not been bought with their assets) which results in either:
a.) source code or assets lost, good luck finding that one dude who backed it up (again older console images are exception but see the lower points)
b.) no one knows who holds the rights or created the game which results in it being illegal to produce or sell by publishers
c.) the worthiness of actually doing something with that IP and hunt down everyone who has anything useful from it
which results in it being an "Abandonware", then you are (almost) free to fuck about with it and enjoy!

It's not illegal to own a program that can play older games. It is illegal to download torrents of the ROMs, not because of theft, but because of copyrights.
The problem is that retards think that piracy = theft, when it's really copyright infringement.
