Either they will have to start from scratch and get rid of all of avellones work or they will have to pay avellone for his work and them some for tarnishing his name.
Either way techland fucked themself on this one and tbqh I think avellone will probably come out finacially better for it.

Why the hell would Avellone keep the writing he did while being paid by Techland? Of course the company keeps the work. They'll just hire some other freelance writer to finish the job and maybe tweak what Avellone has already written.

Imagine you were contracted to build a house in a year, you build the hourse in 364 days with roof tile to put on the house. Do you think the person you are contracted to build the house for can then say lol contract isn't valid anymore, gtfo put the roof tile on themself and keep the house?

Only way that techland wouldn't even have to pay avellone is if some miracle evidence came out that some random roastie on twitter who said he touched me back in 1966 managed to come out with some evidence and get avellone sentenced for rape or some shit.

Essentially, they will have to pay avellone for his work and damages or remove his work and redo it while paying him for damages.

The fuck are you on about? Avellone was paid to work on the game, he did, he was fired. He doesn't get to keep the writing. If I'm doing animation for a game and get fired halfway through I don't keep the animation, it belongs to the company. Any work I've done during company time belongs to the company, whether or not I'm still hired by the end of the project.

You are both correct. It simply depends on the terms of the contract.
It's a moot point though, they'll remove his work in an attempt to appease people who don't play video games.

Firstly, he didn't work for techland or any of the other companies he was doing work for he was under a contract, freelance basically.
Secondly, even if you work for a company and they fire you for such an arbitrary allegation, unless it is stated in your contract that anyone who creates an aligation about you means you are fired you can sue them for big damages and of course, your actual work would be not part of the companies because they didn't fulfil their contractual obligations.

There's no way he'd have a contract like that, think how easy it'd be for him to abuse the fuck out of it.

Show me the news of Avellone suing Techland for damages and I'll concede. Until then there's no reason to assume that he took with him an entire script that he could easily resell while leaving Techland with nothing.

Most contract work of this type wouldn't work like that you're correct. His name was a selling point though so I figure the terms were in his favor.

You won't see this isn the news, most likely this will be done in out of court settlements as it is embarrising and damaging to both parties.
No way does techland want the negative press of being sued for unfair dismilssal over an aligation and avellone wouldn't want irt and if he even raped the roastie of course he wouldn't.
Still no way is techland able to fire him and then use avellones work and no way would he allow it too.
Most likely techland will re write the script.
