You have no way to prove it. Sony did not advertise a noise level for the console and it can easily be argued that it was originally supposed to come out with the quieter fan but had to be swapped for X reason.

All it takes is for a company to knowingly put forward an image of their product that is different to what the general purchaser actually receives. If Sony made sure to only give reviewers the quieter model but general consumers get one that's a lot noisier then that's a case to be made. Sure, Sony have some defences they can use, but that's why this sort of shit gets taken to court in the first place, so that the lawyers can argue over it.

Although that does rely on some law firm deciding there's enough potential money to be made out of this issue if they can turn it into a class-action suit.
