The US could detain innocent japs during ww2. There will always be an authority to seize "freedoms" if the authority feels like it needs to do so. The trick is to get the authority to act in the public intrest and make it keep doing that.
Hitler only got official dictatorial power in 1942 but he never intended that the government should be a dictatorship. Atleast not during peace time.
