I think it would be fine if he keeps the pressure up and shows the Dems to be intractable all the while building a case that he tried everything and was very reasonable until RBG kicks off. Then he can declare a state of emergency and build the wall for real - not 5 billion worth of bits and pieces, but the whole 30 billion thing.
Perhaps he could wait until the confirmation is underway to get sued. Then the confirmation happens tilting things even further in his favor, or it's an ugly battle that makes the sitting SCOTUS irritated with congress' dems. It will be an ugly fight anyway.
