Foreign policy 'national emergencies' are very common, whereas domestic 'national emergencies' for non-emergency political funding are probably unconstitutional. It's not really wrong to point this out - if things go well, it stops another bullshit national emergency. If they go poorly, we can point to the government actively undermining the constitution (again), point to how frequently this has been happening, and use the issue as a symbol to bolster questions of state legitimacy.
