Judicial fascism is coming to America…unless we convince the Senate to reject Kavanaugh!
President Trump has appointed Brett Michael Kavanaugh, a far-right federal appeals court judge, to the soon-to-be vacant seat on the U.S. Supreme Court currently occupied by right-leaning Associate Justice Anthony McLeod Kennedy.
Kavanaugh, if confirmed, would represent the fifth man of a five-justice bloc of hardline fascist activist judges, the other four being Chief Justice John Roberts and Associate Justices Samuel Alito, Neil Gorsuch, and Clarence Thomas, who believe that their far-right ideology, including opposition to abortion rights, opposition to LGBT rights, opposition to worker’s rights, opposition to voting rights, and turning the Constitution’s Bill of Rights from a shield to protect the civil liberties of We the People into a tool that right-wing extremists can use to discriminate against their fellow Americans. Make no mistake about it, if Kavanaugh is confirmed by the Senate, judicial fascism would be coming to America, and that would be a complete and total disaster for our country.
Currently, Trump is a subject of a federal criminal investigation, led by Special Counsel Robert Mueller, into allegations of collusion between Trump’s presidential campaign and the far-right, authoritarian Vladimir Putin regime in Russia. This investigation has already led to guilty pleas, criminal indictments, and increasing amounts of evidence that the the Putin regime in Russia helped get Trump elected to the U.S. presidency. The U.S. Senate has the ultimate responsibility of either confirming or rejecting Kavanaugh’s appointment to our nation’s highest judicial bench, and the Senate’s own Intelligence Committee, which is controlled by Trump’s Republican Party, has concluded that the Russian government interfered in the 2016 U.S. presidential election in support of Trump.
When it comes to presidential accountability, Kevin Kavanaugh is a complete hypocrite. After playing a key role in the partisan, Republican-backed effort to impeach Bill Clinton because of the Monica Lewinsky scandal (Clinton was acquitted in the Senate’s impeachment trial), Kavanaugh, after having worked in the George W. Bush Administration, authored a 2009 Minnesota Law Review article in which Kavanaugh argued that, among other things, the sitting President of the United States should be effectively above the law. Most notably, Kavanaugh wrote that “…Congress might consider a law exempting a President—while in office—from criminal prosecution and investigation, including from questioning by criminal prosecutors or defense counsel”. The portion of the Kavanaugh article that I quoted can be found on the eighth page of the PDF file I linked to in this paragraph. If the Senate were to vote to confirm Kavanaugh, the Senate would, in effect, undermine the stature of their own Intelligence Committee’s report on Russian interference in the most recent presidential election in this country.
The far-right in this country has long made it clear that they want to bastardize the U.S. Constitution and implement a far-right agenda by judicial fiat. If Kevin Kavanaugh’s appointment to the Supreme Court is confirmed, that would be a major step towards completing the far-right’s decades-old goal of installing a Supreme Court controlled by at least five far-right judicial activists who serve authoritarian-minded leaders like Donald Trump, religious fundamentalists, white supremacists, and the wealthiest Americans instead of making a good faith effort to truly uphold the Constitution and ensure that the rule of law is fully and fairly applied.
